What is Conditional Registration?

A Historic or Prescribed Left Hand Drive Vehicle which is more than 30 years old and owned by a financial member of the Austin 7 Club of SA Inc may be Conditionally Registered and be driven on the roads for up to 90 days a year. Vehicles cannot be registered in company or business names. In recognition of its limited use, no registration is payable. The only fees payable are a Transport SA administration fee, a number plate fee (when applicable) and the premium for Compulsory Third Party Insurance. Stamp Duty is not applicable for these vehicles.

What Vehicles may be Conditionally Registered?

A Historic or a Prescribed Left Hand Dive Vehicle as defined below.

What is a Historic Vehicle?

A vehicle

· where 30 years or more have elapsed since 1 January of the year in which the vehicle was manufactured; and

· has not been altered from its original design other than as permitted in Part 7 of the Code of Practice.

What is a Prescribed Left Hand Drive Vehicle?

A vehicle

· that has its steering wheel on the left hand side

· which was manufactured before 1 January 1974, and

· has not been altered from its original design other than as permitted in Part 7 of the Code of Practice.

Does the vehicle have to comply with the Road Traffic Act?

Conditionally Registered vehicles are not exempt from any provisions of the Road Traffic Act (unless otherwise specifically stated in the Road Traffic Regulations, or stated in the “Left Hand Dive Exemption” issued in respect of the specific vehicle).

Does the vehicle have to be Roadworthy?

Yes. The owners of Conditionally Registered vehicles have the same responsibility as other vehicle owners and must ensure that the vehicle is roadworthy at all times whilst being driven.

How does a member apply to Conditional Register a vehicle?

Ensure the vehicle complies with all of the above conditions.

Obtain a completed MR334 form from the Club Registrar. A form may only be issued by the Club Registrar if he/she is satisfied that the vehicle complies with the eligibly requirements as above.

At any Transport SA Registration & Licensing office

· complete an “application for Registration & Third Party Insurance” form (form MR1).

· submit the MR1 & MR334 form along with payment of the appropriate fees & charges (periods registration are available for 1, 2 or 3 years).

· apply for a “Special Extension” if it is considered beneficial (see note below)

· receive a Certificate of Registration.

Arrange for the Club Registrar to issue a Log Book

What is a “Special Extension”

A notation issued by Transport SA that allows the vehicle to be driven a short distance for the purpose of:

· re-locating the vehicle from one part of his/her property to another part of that property, or

· to enable another registered vehicle to exit/enter that property, or

· enable the vehicle to be safely loaded/unloaded from another registered vehicle.

How are Log Books issued?

The Club Registrar will, upon receipt of the Certificate of Registration from the club member, issue a log book. The certificate may be hand delivered or mailed to the Club Registrar. If mailed, the Club Registrar will return the certificate & log book to the member by return mail. Upon Receipt of the Log Book, read the instruction on the reverse side of the front cover

Does a vehicle need to be inspected by Transport SA or the SA Police before Conditional Registration is effected?

If it can be established that the vehicle has previously been registered in SA it does not need to be inspected by Transport SA. However if it cannot be established that a vehicle was previously registered in SA then the vehicle is required to undergo a vehicle identity test by Transport SA.

How is the log book used?

For the Log Book to be valid it must contain

· Details of the registered owner & the vehicle as well s the owners signature

· Confirmation that the owner is a current Club Member

· Confirmation that the vehicle is currently registered

· Details of every day the vehicle uses the road network – one line for each day of use (this must be completed prior to the vehicle being driven on a road each and every day it does so).

What are the Conditions of Use applicable to Conditionally Registered vehicles?

· The owner (not necessarily the driver) must be a financial member of a recognised club.

· The Log Book must be up to date & carried in the vehicle every time it is driven on the road.

· The Log Book must be produced for inspection if asked to do so by a Police person or Transport Inspector.

· Must not be driven on the road for any more than 90 calendar days in any 12 month period of registration.

· Must not be used for Hire, Fare Reward or any other form of remuneration.

· If the vehicle is a commercial vehicle, it must not be used to carry loads for commercial purposes

What would happen if the Conditions of Use are contravened?

If convicted,

· there is a fine of up to $750 (see section 8 of the Code of Practice for full details)

· the whole of the prescribed registration fee that would have been payable, had the vehicle not been Conditionally Registered, along with any applicable stamp duty, would be payable.

What needs to be done when Conditional Registration is renewed?

Transport SA will invite renewal of registration, prior to the expiry date of the current registration, as it does for normally registered vehicles. There is no need to get another MR334 form the Club.

The member needs to:

· pay the appropriate fees to renews the registration.

· arrange for the new Certificate of Registration & Log Book to be endorsed by the Club Registrar either in person or by mail.

What needs to happen when Club Membership is renewed each year?

The member needs to have the Log Book endorsed by the Club Registrar no later than the end of February each year.

What happens if the member of a Conditionally Registered vehicle does not renew his/her membership by the end of the February each year?

The Club must advise Transport SA that the member has not renewed his/her membership. If the Conditionally Registered vehicle is driven on the road after that time, the owner/driver would be contravening the prescribed conditions of Conditional Registration (unless they have joined another recognised club & confirmed such with Transport SA & had another log book issued by that club).

Can the vehicle be used outside of South Australia?

Yes, providing it complies with all prescribed conditions.

What happens if a Conditionally Registered vehicle is sold?

Registration of the vehicle is not transferable

There is no refund for from Transport SA for the remainder any registration period.

The Log Book must be returned to the Club Registrar for cancellation prior to return to the owner of the vehicle.
